User Agreement

Greeting
Welcome to Qari application specialized in teaching the
correct reading of the Holy Qur’an. The Qari application enables users to
communicate with proficient Holy Qur’an teachers around the world as independent
teachers, through direct voice contact to recite the Holy Qur’an and memorize
it with one of the frequent Qur'anic Readings (qirāʾāt).
- The user agreement - this agreement -
applies to users who request and use this service on Qari application for smart
devices (the application).
- Please read this Agreement carefully.
- By clicking on “I Agree” and “Sign
Up” to create user account, you
acknowledge that you read, understand, and agree to be bound by this agreement.
- If you do not agree to all the terms and
conditions of this Agreement, please do not agree. In case, you will not be
able to use Qari services.
General Disclaimer: The application is just an online platform for Holy Quran teachers
and users.
- Qari does not hire or employ tutors and
is not responsible for any interactions between providers, users, and their
respective clients.
- Qari is not responsible for disputes,
claims, losses, or damage of any kind as a result of users' non-compliance, or related to
information or actions of instructors or users, including – but not limited -
any user's reliance on any information provided by the teacher.
App Overview:
Qari application seeks to facilitate the
learning of the Holy Qur’an (recitation and memorization) for different
classes, through smart device applications, as the application provide
individual sessions with selected elite reciters available 24 hours.
Privacy policy:
The
privacy of Qari users is the most important thing that we try to maintain the
confidentiality and security of any personal information that you provide
during your use of Qari.
It
is not allowed to any third party except for " the teacher, the learner,
the supervisor, and the monitor" to view the details of the sessions, only
with getting the written permission of the user. Qari uses protection software
program and secure quota stores. However, it is not bound by its users to
breaches and attacks outside its control that it may be exposed to by passing
protection and insurance, and the user waives in advance any legal claims if
such breaches occur.
Rules of conduct for using the application:
Application Usage:
You
agree and acknowledge that you are fully responsible for your use of the
application and the materials that shown through your own username, which shall
include the whole content you share and
post on the application, including- but not limited to- all posts within
Quotas, notes, questions, comments, videos, and file uploads (user posts).

You agree on the use of the application
in compliance with the agreements and all applicable local, regional and
international laws, rules and regulations, including copyright laws, and any
laws regarding the transfer of technical data exported from your country of
residence.
-Through this document, as a condition for your use the services that Qari introduces, you will not use Qari application in any manner intended to abuse, disable, impair or overburden Qari server or Qari network(s) connected to any of its servers or interfere with any third party and enjoyment of the Application .
It is not allowed to try unauthorized
access to Qari application and other accounts, computer systems, or networks
connected to any server for Qari through hacking, password mining, or any other
means.
It is not allowed to obtain any stored material or information
on Qari application, or any servers or
associated computers through any unavailable mean intentionally through the
application.
- Qari application users and instructors
are responsible for compliance with all local rules, laws and regulations
including, but not limited to, intellectual property, internet, technology,
data, email or privacy rules.
- By this agreement, you undertake not to
use credit cards, payment cards, or any other payment method that you do not
have full authorization from its owner to purchase educational minutes through
it. This including -but not limited to- fake online payment cards, stolen
online payment cards, online payment cards that are not authorized to be used,
and Qari application and its partners reserve the full right to refer violators
of financial transactions laws to the competent judicial authorities or provide
user details to the relevant devices in the user's country.
-you have fully responsibility to report us if you believe that the provided content violates your privacy, any law or any regulation, or that the information provided is inaccurate or poses any risk whatsoever to a third party, so that we can rectify the situation.
- you can report us to persevere copyright
and do the necessary, if you believe that content provided by a third party or
any content violates the use terms of the application or violates any
applicable laws or regulations including – but not limited to -copyright laws.
Prohibited Behavior in classes and
application:
In connection with your participation in
any class, you agree not to engage in any activity that would infringe any
third party intellectual property rights or that would be iniquitous,
defamatory, threatening, pornographic, harassing, hateful, or racially,
sectarian or ethnic, whether offensive or encourages inappropriate conduct which is considered criminal offense
,or provokes civil liability and violates the law.
- You agree to participate in educational classes for learning the Holy
Quran only.
- You acknowledge that Qari has no duty to
monitor a class or control the content of any class, that you may be exposed to
material you find it objectionable while
participating in a class and you must take into your consideration that Qari
has no responsibility related to it.
- Qari may, at any time, remove any user
who violates this agreement at Qari discretion.
- To report any inappropriate activity in relation to an educational session, please report it by sending a message to the following e-mail: info@qari.sa
The list of strictly prohibited
materials from being published or
delving into are the following:
- Falsehoods or misrepresentations that
may harm Qari or any third party.
- Material that is iniquitous, defamatory,
threatening, pornographic, immoral (which offends Islamic morals), harassing,
hateful, or racially, sectarian, or ethnic, or that encourages
inappropriate conduct that would be
considered as criminal offense, provokes civil liability, or violates any law.
Contents/topics related to partisan
political activities.
- Advertisements or solicitations do not
endorse Qari, or publish any opinion, recommendation or advice that other
teachers or students express, and Qari expressly disclaims any liability
related to such opinions, recommendation or advice.
- Viruses, Trojan horses, worms, time
bombs or corrupted files, malware, spyware or any other similar programs that
may damage the functioning of a computer or other properties.
Any violation of the aforementioned
prohibitions provisions entitles Qari to terminate your use and access to the
application and the service without prior notification.
Through this agreement you are bound by the following rules:
- I will register for one account only,
with my real name, committing to the
validity of my personal data.
You understand and acknowledge that you
may be exposed to content that is inaccurate, offensive, indecent, or
objectionable, and you agree to waive and hereby waive any legal or equitable
rights or remedies you may have from Qari with respect thereto.
Application services:
- The application provides the service of
teaching the Holy Qur’an through well-qualified teachers, as the services vary
between correcting the recitation, indoctrination, and recitation.
- The application may add educational
services to develop the Quranic lesson, but it does not commit to its users
with more than what is presented in the application.
The teacher (the reciter):
- The teachers in Qari are the memorizers
of the Holy Qur’an who are proficient and well- skilled in teaching the Holy
Qur’an verbally.
- All reciter teachers are subjected to a
testing process (written, oral) to measure their memorization and mastery of
the Holy Qur’an, knowledge and applied skills of intonation, and methods of
teaching the Holy Qur’an, before they are allowed to interact with the
application’s users.
Qari
teachers are subjected to periodic evaluation by the application evaluation
committee to ensure continued quality of their performance and interest.
Qari
acknowledges that it is not his duty to verify any certificates, licenses or
experiences of any teacher.

Fees:
Payment of fees:
-
Users pay fees according to the fees listed in the application for specific
educational minutes, prior to the specified educational class , and the
educational minutes are calculated at the same
time the educational class begins.

The Application may also offer to use the service through other payment plans
such as monthly subscriptions.

In the event that the service is requested, payment is made through the payment
methods displayed in the application.

All payment terms and conditions are subjected to applicable agreements.

The fees displayed do not include any taxes that may be due in connection with
these fees, other than taxes on the basis of the net profit of Qari application
responsibility.
Payment
Currency: All fees are to be paid in Saudi Riyals or US Dollars.
Calculation of service fees:
- Your use of the purchased minutes will
be counted, starting from the first minute of the educational session.
- Any part of a minute in a lesson will be
counted as a whole minute.
- If the paid minutes run out before the
class ends, the class will end and you will be asked to purchase more minutes.
Fee refund:
The purchased minutes are not refundable,
and the minutes used for the educational classes are not refundable.
- In the event that minutes that you did
not purchase are charged by error, you can request a refund by contacting
technical support. A refund request must be sent to Qari within thirty (30)
days of the time the error occurred in order to take this in the consideration.
You also agree to pay any costs and
expenses incurred by Qari, including attorneys' fees, in recovering any fees
due under this agreement.
Devices and programs
- Participation in a class requires
compatible devices and may require download and installation of specific
programs.
- You are solely responsible for
obtaining/installing any such device and program and determining compatibility
with your system, and therefore you assume all risk and liability associated
with such device and program.
- You acknowledge that you are responsible
for reviewing and complying with all applicable license agreements and other
terms and conditions relating to all programs that you use in connection with
the classes, the application, and the service in general.
- The application is compatible with
Android and iOS operating systems.
Data usage:
The application use requires the use of data
services provided by your wireless or mobile data service provider, and you
acknowledge and agree that you are solely responsible for data usage charges
and any other charges that your wireless or mobile data service operator may
charge in connection with your use of the application.
Audio educational classes:
- The educational classes in general: The
application allows you to request an educational session via audio conversation
and participate in it with a teacher who is a specialist (a proficient
memorizer of the Holy Qur’an) for the purposes of correcting the recitation,
memorization, or recitation of the Holy Qur’an.
You agree to participate in tutorials
solely for your own educational purposes not commercial ones and agree not to record, copy,
redistribute, broadcast, publicly perform, or publicly display any such
tutorial, except as what the agreement permits.
Teacher Availability:
- Lessons are subjected to teacher
availability, and Qari does not guarantee the availability of any particular
teacher (Hafez) at any specific time.
- You hereby acknowledge that all tutors
are independent contractors providing their services to you through the
application and are not employees or agents for Qari.
- The App makes no representation or
warranty regarding the results of participation in a class, including- but not
limited to -that your experience with a teacher will meet your expectations or
aims.
Teacher notes:
- Teachers can take notes for you
regarding your reading level and other information about your learning of the
Qur'an that may be discussed during the lesson.
- Qari staff and subsequent teachers may
view, use, and add to the notes.
Educational classes registration:
Lessons may be recorded or monitored by
the application through the provider of the voice chat, so you hereby agree
that:
Monitoring or recording any educational
session you participate in.
Completely copy and use these recordings
for any commercial purpose, including -but not limited to- the purposes of
teacher evaluation, teacher training, dispute resolution, and service
improvement.
- The use of some of these recordings
by Qari for advertising and marketing
purposes.
Making
those recordings available for you to review.
- Displaying those recordings to the
person who gifted their minutes (Al-Muhdi).
- Qari use and disclose these recordings to the extent required by
law or legal process or to the extent that Qari deems necessary for the
purposes of enforcing or protecting its own rights or those of a third party.
- By this agreement you waive any rights of publicity, privacy, or other rights under applicable law to the extent that you may use those rights to prevent Qari from using the class recordings as described below, and hereby you will be provided with non-exclusive, fully paid-up worldwide royalty rights free license - irrevocable, perpetual, sub licensable, and transferable under any intellectual property rights you may have or in any recording of the class or content to Qari to copy, modify, distribute and use such recording and content for its own commercial purposes or as required by law or legal process .
User accounts and permissions:
Registration:
In the event that you wish to use the
services of Qari, you must register and create an account through the
application. Registration requires the following:
Creating a unique username and password.
Providing
an email address.
Providing
a mobile phone number.
Indicating
your current country of residence.
- Indicating your native language.
Indicating your gender.
Indicating your age.
Personal use:
Your Qari account and the minutes you
purchase for use with your account are for your own use only. You agree not to
share your username and password or allow anyone else to access your Qari
account.
Password:
you
will be asked to provide a password when registration because you will be
responsible for all charges and other activities that occur by your password,
you agree to maintain the confidentiality of your password. You are solely
responsible for maintaining the confidentiality of your account and password
and for restricting access to your device, and you agree to accept
responsibility for all activities that occur under your account or password. If
you have reason to believe that your account is no longer secure (for example,
if a loss, theft, or unauthorized disclosure or use of your account ID or
password occurs), you will notify Qari immediately. You may be liable for
losses incurred by Qari or others due to any unauthorized use of your account.
Availability of the service in the
application:
Qari may make changes to or discontinue
any of the media, products or services available within the application at any
time and without notification. The media, products, or services on the
application may be out of date, and the application makes no commitment to
update such material on the application.
Disclaimers and Warranties:
- The application hereby provides you (the
user) a limited, non-exclusive warranty and a non-transferable license to
access and use the content provided in the application and the educational
class for which you have paid all fees for personal use and not for commercial
purposes through the application and its services in accordance with the terms
of this agreement.
- The application, any third party and any
services, content, information, software, media or applications provided
directly or in conjunction with or through Qari are provided on an “as is” or
“as it is available ” without warranty of any kind (expressed, implied or
otherwise). Qari disclaims all warranties, expressed or implied including
–without limited to- implied warranties and proprieties rights.
- Qari and its licensors and partners do
not warrant that the application will operate uninterrupted or error-free, that
its deficiencies will be corrected, or defects or malfunctions in the service
will be corrected and made available free of viruses or other harmful
components.
You agree, to the fullest extent permitted
by applicable laws, that Qari or any of its partners or licensors shall not be
liable for any loss or damage, whether actual, consequential, arising out of or
related to these terms of service, your (or any third party's) use or your
inability to use the application, topics of content on the application, or your
sole reliance on information obtained from or through the application, whether
your claim is based on contract, tort, statute, or otherwise.
- In particular, and to the maximum extent permitted by applicable law, neither Qari nor any of its partners shall be liable for any direct, indirect, punitive, special, exemplary or incidental damages and whether Qari or any of its partners has been negligent or at fault including- without limited to- claims for defamation, errors, loss of profits, loss of data, or interruption in data availability.
Brand restrictions:
You may not use framing techniques to
enclose any trademark, logo, or other Qari material without express written
consent. You may not use any Qari logos, graphics or trademarks, including any
meta tags or any other “hidden text”, without our express written consent,
except for the permitted in this agreement.
Property rights:
The service is owned by Qari. The videos,
content, visual interfaces, information, graphics, design, compilation,
computer code, products, software, services, and all other elements of the
service and application (Qari Materials) are protected by copyright, trade
mark, patent and trademark laws, international conventions, and all applicable
intellectual property rights and laws. All trademarks, service marks and trade
names are owned by Qari . Except for the expressly authorized by Qari , you
agree not to sell, license, distribute, modify or create derivative works from
Qari.
Member disputes:
You are the only one who is responsible
for your sharing with other teachers or students. Qari reserves the right, but
has no obligation.
In this agreement:
You agree that Qari has the right in compliance with its sole
discretion for any or without reason, terminate this agreement or any part and
remove and discard all or any part of your account at any time. Qari may also
in its sole discretion and at any time discontinue providing access to the
service, the application or any third part, with or without notification. You
agree that Qari will not be responsible for you or any third party at all. Qari
does not permit copyright infringing activities on the service or application,
and reserves the right to terminate access to the service or application, and
remove all submitted content, by any persons who violate its rights repeatedly.
It is possible to refer any suspected fraudulent, abusive, or illegal activity
that may cause the termination of your service use or application to the
appropriate law enforcement authorities.
Communication:
By this agreement ,you agree to receive messages from Qari
online. We will communicate with you by email or by posting advertisements or instructions
about the service or application. You agree that all agreements, notifications,
disclosures and other correspondences that we provide you online satisfy any
legal requirement that such correspondences must be written except for expressly provided, legal notifications must
be provided in Qari via the email address that Qari provides during the
registration process. Qari acknowledges to verify the submission of the notification within 24 hours of
sending the email, unless Qari is notified that the email address is invalid.
Amendment in the agreement:
Qari may make modifications, deletions, or additions to this
agreement at any time, where such changes are effective with respect to
existing users, the user interface will notify you with changes of the
application. When you choose or expressly agree to the changes or a version of
this agreement that includes the changes, whichever comes first. If you provide
written notification that you do not
accept a proposed change or expressly decline to agree to a proposed change,
Qari may (at its sole discretion) either allow continuous use of the application in accordance with the
terms and conditions of the present agreement without changes, or terminate
this agreement and your use of the application.
Governing Laws and Dispute Resolution:
In the event that we end up in a legal
dispute, you and Qari agree that the laws of Saudi Arabia Kingdom shall govern
exclusively for disputes relating to this contract or the services. We both
agree to the personal jurisdiction of the courts located in Saudi Arabia
Kingdom.
Complaints and suggestions:
Complaints:
Qari has dedicated channels for user
complaints, and users also can submit
complaints via e-mail to info@qari.sa
Suggestions:
Qari encourages users to submit any
suggestions related to developing and improving the performance of the
application and services, and Qari
receives suggestions on the e-mail info@qari.sa
General Provisions:
- It is not possible to waive about any of
provisions without the written permission of Qari.
The failure of any party at any time to seek enforcement of any provision of this agreement has no effect on this party's right to enforce it later.
The waiver of any breach of any provision
of this agreement shall not be construed as a continuing waiver of any further
breaches of the same or other provisions of this agreement.
- You can terminate your subscription to
the application at any time if you no longer wish to do so. The rights granted
to you by this Agreement will terminate upon termination of your right to use
the application, but the other provisions of these service terms will survive.
Full agreement:
All of the terms of this agreement and
privacy policy constitute the full agreement between you and Qari with respect
to your use of the application, and supersede any prior agreements between you
and Qari regarding your use of the application.
